Application (Case N1/0631-07): Citizen M.P. has applied to the Ombudsman with a complaint, that in 30.07.2008 the RA Administrative Court partially satisfied the claim to eliminate the inactivity of the respondent (Yerevan Municipality), obligating the latter to follow the Yerevan Municipality decision and to sign lease agreement with M.P.
In 24.09.2008 an enforcement case was proceeded in the Enforcement Service of the RA Ministry of Justice, but no measures were taken by the Enforcement Service towards the verdict implementation.
Solution : After studying the case the Ombudsman applied to the Yerevan Municipality and the Enforcement Service of the RA Ministry of Justice for receiving clarifications.
Result: After studying the case the Ombudsman decided, that the citizen’s rights have been violated by the Enforcement Service of the RA Ministry of Justice and, with the aim of restoring the citizen’s rights, suggested to solve the issue of subjecting the official, who has flawed in implementation of the court verdict, to disciplinary liability and take measures to prevent such violations.
