When to apply
Apply to the Human Rights Defender, if the following state bodies have violated your rights
- The municipality of Yerevan
- Has failed to take measures preventing constructions which violate urban development norms, construction in yards or green spaces of general use, deforestation and unauthorized building construction,
- Has unreasonably refused the provision of construction authorization or has provided an illegal construction authorization,
- Has unreasonably refused the legal provision of utilization and rent of real property, or has unreasonably terminated those rights,
- Has unreasonably refused applications regarding changing type of property right, provision of construction authorization, legitimization of an unauthorized construction, property right recognition with confirming documents and legitimization of unauthorized constructions,
- Refuses to sign an agreement on land utilization and rent,
- Doesn’t provide a land plan upon request.
- The Real Estate Cadastre State Committee
- Has unreasonably refused registration of property utilization, construction, mortgage or servitude right, or hasn’t informed in written form about the reasons of refusing,
- Has unreasonably refused an application regarding the correction of mistakes,
- Has refused to give information about registered property rights upon request.
- The State Tax Service
- Has conducted an inspection without the availability of a decree /instruction/, or an official who wasn’t indicated in the decree or instruction has taken part in the inspection,
- During the inspection has impeded the regular working process of the economic entity,
- More than 15 continuous working days have been defined for 1 inspection term,
- Without a written agreement of an economic entity official, has published information regarding economic entity’s transactions, disclosed during inspection, which the economic entity intended to keep in secret, as well as has published information which is a commercial secret,
- Hasn’t answered in written form to the economic entity’s director’s or its substitute’s written query about the audited period during the inspection,
- Hasn’t maintained qualitative and quantitative integrity of temporarily taken documents, things, samples and other necessary materials, as well as their return,
- Hasn’t implemented the court verdict which has already entered into force,
- Has applied sanctions for an illegal business activity, the legitimacy of which is disputable.
- Urban municipalities, rural municipalities, regional municipalities
- Haven’t provided the necessary information or documentation,
- Have violated rights guaranteed by housing projects /housing allocation, improvement, etc./,
- Have violated land users rights,
- Have unreasonably refused applications regarding changing the type of property right, provision of construction authorization, legitimization of an unauthorized construction, property right recognition with confirming documents and legitimization of unauthorized constructions,
- Have implemented illegal land allocations or provided illegal construction authorization,
- Have calculated or collected additional property or land taxes in excess of the required amount.
- The RA Enforcement Service
- Hasn’t implemented or undertaken requirements of judicial acts,
- Hasn’t made a decision about initiating enforcement proceedings within the 3 days period after receiving a writ,
- Hasn’t implemented executive actions within the 2 month period after receiving a writ,
- Has implemented executive actions during non-working hours - 20:00-08:00, in a case where there was no necessity of immediate implementation of executive actions, and where they could have been implemented during working hours,
- Hasn’t implemented debtor’s and /or its property’s research.
- The Police
- Has refused to receive a report on a crime,
- Hasn’t clarified to the injured his rights and obligations,
- Has apprehended a citizen and kept him/her more than 3 hours without determining his/her status as a: witness, suspect, accused or injured
Has compelled someone to give evidence, which is false,
- Has kept a citizen in the section of police station or in prison for longer than 72 hours without making a protocol about arrest and without proposing charge against him/her,
- Has deprived a citizen from an opportunity to meet an advocate,
- Hasn’t given a detained person an opportunity to inform relatives about his/her location,
- Has beaten and tortured a citizen,
- Has unreasonably taken the passport from a citizen.
- The Prosecution
- Hasn’t processed complaints,
- Has given baseless answers to complaints,
- Upon reasonable request from a citizen, fails to protest court verdicts, sentences and decisions, which that citizen believes have been wrongfully made.
- Armed Forces
- Have called up for military service a citizen, who wasn’t subjected to enlisting,
- Have deprived a serviceman who hasn’t committed a violation during service, from the opportunity to have a vacation,
- Have unreasonably deprived a serviceman from his right to serve near his dwelling place,
- Have unreasonably delayed the provision of a service record,
- Haven’t provided medical assistance and research free of charge for serviceman’s family members.
- The Penitentiary
- Has beaten, tortured or has cruelly treated a prisoner or a convict,
- Has violated the provision stipulating which type of incarceration regime a prisoner should be subject to open, semi-open, closed, semi-closed to the detriment of a person,
- Hasn’t provided necessary nutrition for a person’s organism’s regular bioactivity, or has reduced food ratio as a sanction,
- Hasn’t provided or has provided incomplete medical assistance in dispensary,
- Hasn’t provided delivery or receipt of prisoners’ letters.
- The Social Security Service
- Has unreasonably refused designation of pension,
- Has incorrectly calculated a pension, or hasn’t taken into consideration work experience while calculating the pension,
- Has refused to make a recalculation of pension,
- Has refused to designate a pension with preferential conditions to persons corresponding to lists of difficult or hazardous productions, jobs, professions or positions,
- Has refused the payment of pension based on a notarized warrant or equalized to notarized warrant /Part 4 of the Article 321 of the RA Civil Code/,
- Has refused to provide partial pension or has incorrectly calculated the professional work experience, which gives a right to a partial pension.
- The Social Service Agency /Pharos/
- Has unreasonably refused to provide allowances,
- Hasn’t provided the lump sum benefit, urgent assistance or lump sum financial aid due,
- Has unreasonably reduced the amount of lump sum pension or has terminated the payment,
- Has unreasonably refused or delayed provision of reimbursement for financial contribution to families, which were continuously getting a pension from 1 July 2005 until 1 April 2006, invested till 10 June 1993.
- The Social-Medical Expertise Agency
- Has unreasonably refused to recognize a citizen as disabled,
- Has defined an inappropriate disability group for a citizen,
- Has unreasonably refused to carry out a reexamination of a person with disabilities,
- Has unreasonably changed the disability group of a person as a result of reexamination or has deprived him/her from disability category.
- The State Labor Inspectorate
- Hasn’t processed complaints regarding employments rights violations in employee-employer relations,
- Hasn’t organized events preventing industrial injuries and occupational diseases,
- Hasn’t taken necessary measures towards provision of safe job conditions,
- Hasn’t controlled the protection of employees’ rights and legal interests during the privatization and liquidation of organizations.
- The State Migration Service
- The Ministry of Health
- Hasn’t ensured or has partially ensured a medical assistance free of charge, guaranteed by the government,
- Hasn’t ensured free provision of medicines, guaranteed by the government,
- Has refused to accommodate a citizen in a psychiatric institution, carry out necessary expertise or has refused to provide with appropriate materials and documents.
- The Civil Status Acts Registration Agency
- Has unreasonably refused to make a registration of acts of birth, devorce, adoption, paternity determination, name changing and death /hereinafter- civil status acts/,
- Hasn’t informed in written form about the basis for the rejection of civil status acts
- Has rejected the implementation of changes, additions and corrections in civil status acts, denouncement of those records, reinstatement of lost records, provision of copies of certificates.
- The Ministry of Urban Development

- Hasn’t created necessary conditions for the improvement of housing conditions, preservation and safe utilization of multi-apartment buildings,
- Hasn’t ensured the seismic stability of buildings and constructions,
- Has unreasonably rejected the licensing of certain types of urban development.
